1. Acceptance of Terms

By accessing or using the My PCAP platform (“the Service”), operated by the Professional Criminologists Association of the Philippines, Inc. (“PCAP”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and PCAP. Your continued use of the Service following any changes to these Terms constitutes your acceptance of such changes.

2. Description of Service

My PCAP is the official national digital registry and Smart ID platform for licensed criminologists in the Philippines. The Service provides:

  • Digital member registration and credential management
  • Smart ID generation with QR-based verification
  • Certificate of Good Standing (COGS) processing and issuance
  • Credential verification for employers, institutions, and regulatory bodies
  • Regional and national membership administration
  • Access to training provider seminars and professional development programs

PCAP reserves the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Eligibility

To use the Service, you must:

  • Be a licensed criminologist with a valid Professional Regulation Commission (PRC) license, or an applicant in the process of obtaining membership
  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not have been previously suspended or removed from PCAP membership for cause

By registering, you represent and warrant that you meet all eligibility requirements.

4. Account Registration

When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration and keep it up to date
  • Maintain only one account per person — duplicate accounts may be suspended or merged
  • Keep your login credentials confidential and not share them with any third party
  • Be solely responsible for all activity that occurs under your account
  • Notify PCAP immediately of any unauthorized access to or use of your account

PCAP reserves the right to suspend or terminate accounts that contain false or misleading information.

5. Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent information, including forged documents or fake PRC credentials
  • Attempt to gain unauthorized access to the Service, other users' accounts, or the systems and networks connected to the Service
  • Interfere with or disrupt the Service, its servers, or its networks
  • Use the Service for any purpose that is unlawful under Philippine law or international law
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission
  • Use automated systems (bots, scrapers) to access the Service without prior authorization
  • Impersonate another person or misrepresent your affiliation with any person or entity

Violation of these provisions may result in immediate account suspension, membership revocation, and/or legal action.

6. Intellectual Property

The Service, including its design, features, code, branding, logos, and content (excluding user-submitted data), is the exclusive property of PCAP and is protected by Philippine intellectual property laws.

You retain ownership of the personal information and documents you submit. By uploading content to the Service, you grant PCAP a non-exclusive, limited license to use, store, and process such content solely for the purpose of providing the Service.

You may not use PCAP's name, logos, or trademarks without prior written consent.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data in compliance with Republic Act No. 10173 (the Data Privacy Act of 2010).

By using the Service, you consent to the collection and processing of your data as described in our Privacy Policy.

8. Payment Terms

Certain services, including membership registration, Smart ID issuance, and Certificate of Good Standing (COGS) processing, require payment of applicable fees as set by PCAP.

  • All fees are published on the platform and may be updated from time to time with reasonable notice
  • Accepted payment methods include GCash, Maya, bank transfer (BDO, BPI, Metrobank, Landbank), and over-the-counter (7-Eleven, Cebuana, Palawan)
  • Fees are non-refundable once payment has been processed and confirmed, unless otherwise required by law
  • PCAP is not responsible for fees or charges imposed by your payment provider

9. Limitation of Liability

To the maximum extent permitted by Philippine law, PCAP and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

The Service is provided on an “as is” and “as available” basis. PCAP makes no warranties, express or implied, regarding the reliability, availability, or accuracy of the Service.

In no event shall PCAP's total liability exceed the amount you have paid to PCAP in the twelve (12) months preceding the claim.

10. Modifications

PCAP reserves the right to update or modify these Terms at any time. When we make material changes, we will notify you via email and/or through an in-app notification at least thirty (30) days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree, you must discontinue use of the Service and may request account deletion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Manila, Philippines. The parties agree to attempt amicable resolution through mediation before resorting to litigation.
